1. What This App Is (and Is Not)

This App provides informational guides, calculations, and predictive estimates only for spotting activities including plane spotting, train spotting, birdwatching, and wildlife spotting.

The App does not provide advice, instructions, authorisation, supervision, or safety guidance.

2. No Accuracy Guarantee

All predictions and locations are estimates only and may be inaccurate, incomplete, delayed, or unavailable due to operational, environmental, or access changes.

3. Location & Access Responsibility

Locations shown may be private, restricted, unsafe, or inaccessible. We do not verify access rights, legality, or safety.

4. Personal Safety & Risk

Spotting activities involve inherent risks. You accept full responsibility for your safety and actions and agree to follow all laws, signage, and official instructions.

5. No Duty of Care & No Reliance

The App does not create or assume any duty of care. Information is provided for general interest only.

6. Aviation & Infrastructure

The App provides informational predictions and estimates only. Real-time aircraft data is sourced from public ADS-B feeds and is not guaranteed to be complete or accurate. The App must not be used for surveillance, monitoring of sensitive activity, or any purpose that could compromise security. It is not affiliated with any military authority, airport, or government agency.

MOD Portal & Military Features: The MOD Portal and related military aircraft tracking features are provided for informational and recreational spotting purposes only. All predictions, status indicators, and activity scores are estimates based on publicly available data and should not be relied upon for operational decisions.

7. Age Requirement

The App is intended for users aged 16 and over. Users under 18 must have parental or guardian consent and supervision.

8. Limitation of Liability

To the fullest extent permitted by law, we are not liable for injury, loss, damage, or legal consequences arising from use of the App.

9. Complaints & Expectations

Incorrect predictions or unavailable sightings do not constitute a fault or failure of service.

10. EU Users

Mandatory EU consumer and data protection rights remain unaffected.

11. Spotter Car Parks & Verified Locations

Verified spotter car parks and locations are provided for informational purposes only. We do not guarantee access, safety, or legality of any location. Always check current access conditions, respect private property, and follow all local laws and regulations. Locations may change or become inaccessible without notice.

12. Subscriptions & Billing

Premium Subscription: Premium features are available via monthly (£4.99/month) or annual (£49.99/year) subscription. Subscriptions automatically renew unless cancelled.

Cancellation: You may cancel your subscription at any time through your account settings or via Google Play/App Store subscription management. Cancellation takes effect at the end of your current billing period.

Refunds: Refunds are handled in accordance with Google Play and App Store policies. We do not offer refunds for partial subscription periods, except where required by law.

Price Changes: We reserve the right to modify subscription prices. Existing subscribers will be notified at least 30 days in advance of any price increase.

13. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the property of SpottersGuide or its content suppliers and are protected by UK and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App without our prior written consent.

14. User Content & Feedback

By submitting feedback, reviews, or other content to the App, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or have the necessary rights to grant the license above and that your content does not violate any third-party rights or applicable laws.

15. Prohibited Uses

You agree not to use the App:

• In any way that violates any applicable UK or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App

16. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

17. Service Modifications & Termination

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We may also terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

18. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
